Welcome to Wrong Side of Customs. These Terms of Service (“Terms”) govern your use of our website, purchase of our products, and interaction with the services offered by Wrong Side of Customs (“Wrong Side of Customs,” “we,” “us,” or “our”).

By accessing our website, placing an order, or otherwise using our services, you agree to these Terms and to any policies referenced herein, including our Shipping, Cancellations, Returns & Refunds Policy and Privacy Policy.

If you do not agree to these Terms, please do not use our website or services.

1. Our Products

Wrong Side of Customs specializes in limited-quantity and heritage fragrances sourced from independent perfumers and artisans in Morocco, as well as products produced or curated specifically for Wrong Side of Customs.

Many of the fragrances we offer are produced, blended, filled, labeled, or finished by hand rather than through standardized industrial manufacturing.

Accordingly, individual products and batches may exhibit natural variations in color, aroma, clarity, texture, fill appearance, labeling, packaging, or other characteristics. Fragrances produced using traditional methods or raw materials may also occasionally contain small amounts of sediment or remnants of raw materials.

These characteristics are part of the nature of small-batch and artisanal fragrance production and do not necessarily indicate that a product is defective.

2. Fragrance Is Subjective

The perception and performance of fragrance vary considerably between individuals.

Skin chemistry, climate, temperature, humidity, application method, storage, maturation, personal perception, and numerous other factors may affect how a fragrance smells or performs.

Descriptions, fragrance notes, impressions, comparisons, photographs, marketing materials, and other information provided by Wrong Side of Customs are intended to help customers understand our products but cannot guarantee an individual’s experience with a fragrance.

A customer’s personal dislike of a fragrance, a difference between expectation and perception, or variation in fragrance performance does not by itself constitute a product defect.

When available, we encourage customers who are unfamiliar with a fragrance to purchase a sample or discovery size before purchasing a full bottle.

3. Eligibility and Use of Our Store

By using this website and purchasing from Wrong Side of Customs, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.

You may not use our products, website, or services for any unlawful or unauthorized purpose or in violation of any applicable law or regulation.

You may not interfere with the security, operation, or integrity of our website or attempt to gain unauthorized access to our systems, accounts, or customer information.

4. Orders

Submitting an order does not guarantee acceptance of that order.

We reserve the right, to the extent permitted by applicable law, to refuse, limit, decline, or cancel an order before fulfillment at our discretion.

Reasons may include, but are not limited to:

suspected fraud or unauthorized payment activity;
payment or billing problems;
inventory discrepancies;
pricing, description, or listing errors;
technical or website errors;
suspected unauthorized resale or commercial purchasing;
previous chargebacks or payment disputes;
suspected abuse of promotions, discounts, claims, or store policies;
orders that exceed stated quantity limitations; or
other circumstances that prevent us from reasonably completing the transaction.

If we cancel an order after payment has been collected and no amount is otherwise properly owed, the applicable amount will be refunded to the original payment method.

We may also limit quantities purchased per person, household, account, payment method, billing address, shipping address, or order where reasonably necessary to protect limited inventory or the integrity of a release.

5. Limited-Quantity Products

Many Wrong Side of Customs fragrances are available only in small or finite quantities.

Adding an item to a cart does not necessarily reserve inventory unless expressly stated otherwise.

Products may sell out quickly, and availability may change without notice.

We do not guarantee that a discontinued, sold-out, limited-release, or heritage fragrance will become available again.

We reserve the right to establish reasonable purchase limits for limited releases.

6. Pricing and Product Information

We make reasonable efforts to ensure that product descriptions, photographs, pricing, availability, and other information on our website are accurate.

However, typographical errors, technical errors, incorrect pricing, inventory discrepancies, or other inaccuracies may occasionally occur.

We reserve the right to correct errors or inaccuracies and, where permitted by law, cancel an affected order before fulfillment.

If an order is canceled because of a pricing or listing error after payment has been collected, the applicable amount paid for the canceled item or order will be refunded.

Product photographs are intended to represent products as accurately as reasonably possible. Colors, materials, labels, packaging, and handmade elements may appear differently depending on lighting, photography, screen settings, batch variation, or artisanal production. We also reserve the right to make packaging substitutions based on availability.

7. Payment

You agree to provide current, complete, and accurate billing, shipping, and payment information when placing an order.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Orders may be subject to payment verification, fraud screening, or additional review before fulfillment.

8. Chargebacks and Payment Disputes

We encourage customers to contact Wrong Side of Customs directly if they believe there is a problem with an order so that we have an opportunity to investigate and address the issue.

Initiating a chargeback or payment dispute does not waive these Terms or any other applicable store policy.

We reserve the right, where permitted by law, to provide payment processors, financial institutions, shipping carriers, insurers, or dispute-resolution providers with relevant transaction information and documentation necessary to respond to a payment dispute.

Previous chargebacks or payment disputes may be considered when determining whether Wrong Side of Customs will accept future orders from a customer. Future orders may be declined or canceled where permitted by applicable law.

Nothing in this section restricts a customer’s lawful rights to dispute a transaction with their financial institution or payment provider.

9. Cancellations, Returns and Refunds

Orders are subject to our separate Shipping, Cancellations, Returns & Refunds Policy, which is incorporated into these Terms by reference.

Unless otherwise required by applicable law, fragrance purchases are final except where provided in that policy, including qualifying situations involving damaged, defective, or incorrect merchandise.

Customer cancellation requests are subject to the cancellation period and conditions stated in that policy.

10. Shipping and Delivery

Order processing, fulfillment, shipping, tracking, lost-package procedures, Route shipping protection, and delivery claims are governed by our Shipping, Cancellations, Returns & Refunds Policy.

Shipping and delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Carrier delays, weather, holidays, service interruptions, customs processing, geographic limitations, and other circumstances outside our reasonable control may affect delivery.

Customers are responsible for providing a complete and accurate shipping address.

11. International Orders

International customers are responsible for reviewing any import restrictions applicable to their destination.

Where applicable, international shipments may be subject to customs processing, duties, taxes, brokerage fees, or other charges imposed by governmental authorities or third parties.

Unless expressly stated otherwise at checkout or required by applicable law, such charges are the responsibility of the recipient.

Customs processing may delay delivery and is outside our direct control.

Nothing in these Terms overrides mandatory consumer rights applicable in a customer’s jurisdiction.

12. Promotions, Discounts and Discount Codes

Promotions and discount codes are subject to any conditions stated at the time they are offered.

Unless expressly stated otherwise, discounts cannot be combined, have no cash value, and may not be applied retroactively to completed purchases.

We reserve the right to correct or cancel discounts resulting from technical errors, unauthorized distribution, manipulation, or misuse, subject to applicable law.

13. Intellectual Property

Unless otherwise indicated, the Wrong Side of Customs name, branding, logos, written materials, original photography, graphics, packaging designs, product descriptions, website content, and other original materials are owned by or licensed to Wrong Side of Customs and its contracted partners and are protected by applicable intellectual-property laws.

You may not reproduce, distribute, modify, republish, commercially exploit, or use our protected materials without permission except as allowed by law.

Nothing in these Terms transfers ownership of our intellectual property to you.

13A. Resale, Decanting and Unauthorized Distribution

Wrong Side of Customs products are intended primarily for personal use and enjoyment. While we recognize that customers may lawfully resell, gift, swap, or otherwise transfer products they have purchased, the purchase of a Wrong Side of Customs product does not grant any license or authorization to use our trademarks, logos, trade dress, packaging designs, copyrighted materials, product photography, or other intellectual property for commercial purposes.

While we support many established and reputable decanters in the fragrance community and may occasionally partner with certain commercial decanters in writing, we particularly discourage the unauthorized commercial rebottling, repackaging, or redistribution of our fragrances, as once a fragrance has been removed from its original packaging, Wrong Side of Customs cannot verify or control its authenticity, handling, storage conditions, dilution, contamination, alteration, labeling, or chain of custody.

Accordingly, any fragrance decanted, rebottled, repackaged, or otherwise redistributed by an independent third party is not bottled, authenticated, quality-controlled, or guaranteed by Wrong Side of Customs, unless we have expressly authorized that seller or distributor in writing.

Use of Wrong Side of Customs Branding

Our name, logos, trademarks, label artwork, packaging designs, and other proprietary branding may not be reproduced or applied to third-party decants, sample vials, bottles, packaging, labels, promotional materials, or other merchandise without our prior written permission.

In particular, independent sellers and decanters may not reproduce Wrong Side of Customs labels or logos, create imitation labels or packaging, or otherwise present a third-party decant or repackaged product in a manner that could reasonably cause a customer to believe that the item was bottled, packaged, authenticated, approved, or supplied by Wrong Side of Customs.

Nothing in this section is intended to prevent lawful, truthful identification of a genuine product where permitted by applicable law. A third-party seller may accurately identify the fragrance being offered, provided that such use does not falsely imply sponsorship, affiliation, authorization, authentication, or endorsement by Wrong Side of Customs.

Authenticity and Third-Party Purchases

Wrong Side of Customs can guarantee the authenticity, composition, fill, handling, and condition of a product only while it remains within our authorized chain of distribution.

We cannot guarantee products purchased from unauthorized resellers, decanters, marketplaces, swap groups, or other third parties, and we are not responsible for the condition, contents, storage, alteration, dilution, contamination, labeling, or representation of products after they have been decanted, rebottled, repackaged, or otherwise modified by a third party.

Claims regarding products purchased from an unauthorized third party should be directed to the seller from whom the product was purchased.

Commercial Distribution

Purchase through our consumer storefront does not create a wholesale, dealership, distributorship, agency, partnership, or authorized-reseller relationship with Wrong Side of Customs.

Businesses or individuals interested in commercially distributing, retailing, sampling, or decanting Wrong Side of Customs products are encouraged to contact us regarding authorization before representing our products commercially.

14. Reviews, Comments and Customer Content

If you voluntarily submit a product review, comment, photograph, testimonial, suggestion, feedback, or other content to us or through functionality provided on our website, you represent that you have the right to submit that material.

We will not remove authentic reviews, even if they happen to be unfavorable. However, you may not knowingly submit unlawful, defamatory, infringing, fraudulent, abusive, or malicious content.

Any use we make of customer-submitted content will remain subject to applicable law and our Privacy Policy.

15. Third-Party Services

Our website may use or provide access to services operated by third parties, including Shopify, payment processors, shipping carriers, Route, social-media platforms, and other service providers.

Those third parties may maintain their own terms, policies, and privacy practices.

Wrong Side of Customs does not control every aspect of third-party services and is not responsible for third-party acts or omissions except to the extent responsibility cannot legally be excluded.

16. Website Availability

We endeavor to keep our website and services available and accurate, but we do not guarantee uninterrupted or error-free access.

We may modify, suspend, discontinue, or update portions of the website or our services when reasonably necessary, including for maintenance, security, technical issues, product changes, or business operations.

17. Prohibited Conduct

You may not use our website or services to engage in fraud, payment abuse, unauthorized access, malicious interference, infringement of intellectual-property rights, unlawful collection of information, transmission of harmful code, harassment, or any activity prohibited by applicable law.

We may restrict access to our services where reasonably necessary to protect our customers, business, systems, or legal rights.

18. Disclaimer of Warranties

To the fullest extent permitted by applicable law, our website, services, and products are provided subject to the warranties and rights expressly stated in these Terms and any warranties or rights that cannot legally be excluded.

We do not guarantee that our website will always be uninterrupted, error-free, or free from every technical problem.

Nothing in these Terms excludes any warranty, guarantee, or consumer right that cannot lawfully be waived or excluded.

19. Limitation of Liability

To the fullest extent permitted by applicable law, Wrong Side of Customs will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of our website, services, or products.

Where liability may lawfully be limited, our aggregate liability arising from a particular transaction will not exceed the amount paid to Wrong Side of Customs for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Wrong Side of Customs and its owners, employees, contractors, agents, and service providers from third-party claims, liabilities, damages, or reasonable expenses arising from your unlawful misuse of our website or services, your violation of these Terms, or your infringement of another person’s rights.

21. Privacy

Our collection and use of personal information are governed by our Privacy Policy.

Please review that policy for information about how personal information is collected, used, shared, and protected.

22. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed where necessary, and the remaining provisions will remain in effect.

23. No Waiver

Our failure to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it in the future.

24. Entire Agreement

These Terms, together with our Privacy Policy, Shipping, Cancellations, Returns & Refunds Policy, and any other policies expressly incorporated by reference, constitute the agreement governing your use of our store and services, except where additional written terms expressly apply.

25. Governing Law

To the extent permitted by applicable law, these Terms and disputes arising from them will be governed by the laws of the State of Nevada, United States, without regard to conflict-of-law principles.

Nothing in this section deprives a consumer of mandatory protections or rights that cannot lawfully be waived under applicable law.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices, technology, or legal obligations.

The version posted on our website at the time of a transaction will apply to that transaction unless applicable law requires otherwise.

The effective date of the current version appears at the top of these Terms.
